Terms of Use

Version 1.2 · Effective 21 October 2026

KaN Learn Hub is an educational tool for learning activities, planning, records and reflection. Adults manage accounts and learner information. AI outputs need review and are not diagnoses or official assessments.

These Terms explain both your responsibilities and ours. Your Australian Consumer Law rights continue to apply. The Privacy Policy explains information handling; acknowledging it is not blanket consent to every use of your information.

Summaries are general information only and do not replace the full document below.

Who operates KaN Learn Hub

KaN Learn Hub (KaN) is operated by Tara Whiteside. Sole trader trading as KaN Learn Hub.

ABN 92 376 321 837. Contact: support@kanlearnhub.com.au. Business and privacy contact details are available on the Contact & Privacy Complaints page.

Agreeing to these Terms

You must actively agree to these Terms before using the account features that require acceptance. The Acceptable Use Policy forms part of these Terms. The Subscription & Billing Terms also apply when you start a trial or paid membership.

The Privacy Policy, Child & Learner Data page and AI & Automated Analysis page explain information handling and the choices available to you. A privacy acknowledgement does not replace a separate permission or consent required for a particular use of information.

We record the document version and date of your acceptance. You can view your acceptance records from Account Settings.

Adult accounts and learner profiles

Account holders must be at least 18 years old and have authority to enter this agreement. A learner may be a child or an adult; a learner profile is not a separate contracting account.

If you act for an organisation, you must have authority to do so. If you add another person as a learner, you must have the appropriate authority and any permissions or consents required to provide and use their information.

Account information and security

Provide accurate account information, keep it up to date, and take reasonable steps to protect your login credentials. Use the sharing features provided by the service rather than giving an unauthorised person access to your account.

Contact us promptly if you suspect unauthorised access. KaN will not ask you to send your password.

Your responsibilities for learner information

Only record or upload information you are authorised to provide and that is relevant to the learner’s use of KaN. Check information for accuracy and correct it when you become aware of an error.

Having a copy of a report, taking a photograph, or being a parent, carer or professional does not automatically give permission for every use or disclosure. Consider the learner’s privacy, the rights of other people shown or named, confidentiality obligations, and any restrictions on the material.

Professional users remain responsible for their own legal, professional, employer, consent and recordkeeping obligations. These responsibilities do not remove KaN’s own applicable obligations.

Educational purpose and limits

KaN provides educational tools to support learning activities, planning, recording, reflection and the organisation of evidence. Using the platform does not, by itself, establish a counselling, therapeutic or clinical relationship with its operator.

KaN does not diagnose medical, psychological, developmental or learning conditions. Its outputs are not clinical assessments, official school assessments, certificates or official determinations of a learner’s overall ability or curriculum level.

KaN can help organise information for home education and other reports, but registration decisions and acceptance of evidence remain with the relevant authority. KaN does not guarantee approval or acceptance of a report.

Learners progress in different ways. KaN does not promise a particular grade, learning improvement or result within a particular timeframe. This does not reduce our obligation to provide the service as described or any rights you have under Australian Consumer Law.

AI-generated resources and adult review

AI-assisted activities, worksheets, analysis, plans and reports can contain errors, omissions or unsuitable suggestions. Review their accuracy, relevance, accessibility and safety before using or sharing them, and use appropriate adult supervision for activities.

AI output should not be the sole basis for decisions about a learner’s health, development or educational support. Seek appropriately qualified advice when needed.

Available AI features and their data permissions are explained on the AI & Automated Analysis page. Do not submit Australian Curriculum source material to AI features; see Curriculum sources, copyright & attribution for framework-specific limits.

Permitted use

You may use KaN for its intended educational purposes for learners you are authorised to support, including in your family, classroom or professional practice where your membership permits that use.

You may use and share permitted reports and downloaded learning resources for those purposes, while respecting the learner’s privacy and any third-party rights. This does not grant permission to resell the platform or repackage KaN’s proprietary templates or resources as a competing product.

Misuse and unacceptable content

Do not use KaN unlawfully, harm or exploit learners, upload material without appropriate rights or authority, access another account without permission, interfere with security, or introduce malicious software. The Acceptable Use Policy explains these requirements.

KaN’s intellectual property

Except for user content and third-party material, the operator owns or licenses the intellectual property in the platform. Protection applies to original expression and other legally protected material, not ownership of learning concepts, facts or curriculum standards.

Your membership gives you permission to use the service for its intended purpose during your authorised access. It does not transfer ownership of KaN’s software, branding or other intellectual property. See Copyright & Intellectual Property for permitted use and restrictions.

Your content and the learner’s work

Uploading content does not transfer its ownership to KaN. Content you own remains yours; a learner’s work and third-party material remain owned by the person who holds the relevant rights.

You give KaN the limited permission reasonably needed to store, display and process the content to provide the service you use, including through service providers and backups. Processing remains subject to the Privacy Policy, applicable law and relevant data permissions.

This permission does not allow KaN to sell or commercially publish private learner content. KaN does not sell private learner records, photographs, reports or work samples.

Privacy and sharing

The Privacy Policy describes the information collected, purposes, recipients, overseas handling and how to raise access, correction, deletion or privacy requests. Sensitive information is optional; only provide it when relevant and with the necessary authority and consent.

Review recipients and content before sharing or exporting learner information. A recipient may retain or share a copy after it leaves KaN. This does not remove KaN’s responsibility for its own handling of information.

External services and curriculum references

KaN uses external services for functions such as hosting, file storage, payments, AI processing and communications. The Privacy Policy describes their roles. Where you use an external service directly, its terms may also apply.

Curriculum and framework material belongs to its respective rights holders. References do not imply endorsement by an education authority. See Curriculum sources, copyright & attribution for source information and applicable limits.

Subscriptions, billing and cancellation

The plan, price, payment frequency, trial conditions and automatic renewal are shown before you authorise a subscription. The Subscription & Billing Terms explain payment, cancellation and refund arrangements.

You can manage cancellation through Membership & Billing. If you do not accept revised terms, you can still contact us about cancellation, refunds, privacy requests or access to your information. We will not require acceptance of new terms simply to make those requests.

Consumer rights and refunds

Nothing in these Terms excludes, restricts or changes a consumer guarantee, right or remedy that cannot lawfully be excluded, including under Australian Consumer Law.

If the service does not meet an applicable consumer guarantee, you may have rights to a remedy such as rectification, cancellation, refund or compensation depending on the circumstances. Contact us so we can address the issue. A change-of-mind cancellation policy does not limit these rights.

Availability and service changes

We aim to provide a reliable service, but maintenance, outages and technical or third-party problems can interrupt availability. Keep copies of records you need independently of your access to KaN.

We may maintain and improve the service. For changes that materially reduce paid functionality or affect your rights, we will give reasonable notice where practicable and explain available choices. Urgent security or legal action may require a quicker change.

If a material change prevents us providing a service you have already paid for, contact us about an appropriate remedy. Statutory rights continue to apply.

Suspension and termination

We may restrict or suspend access when reasonably necessary to address security threats, suspected fraud, unlawful activity, serious breaches of these Terms or overdue payment. We will use a response proportionate to the issue and give reasons and an opportunity to resolve it where appropriate.

We may terminate access for a serious or repeated breach. Where we end a paid service for reasons unrelated to your breach, we will address the unused paid portion fairly, including a refund where appropriate or required by law.

Suspending access, cancelling renewal and deleting an account are different actions. Privacy requests and applicable legal rights remain available. The Data Retention & Account Deletion page explains what happens to information.

Responsibility for loss

Each party’s responsibility for loss or damage is determined under applicable law. Your responsibility to review outputs, provide authorised information and secure your account does not excuse KaN from its own legal obligations.

Our use of external providers or AI does not remove obligations owed by us under applicable law. Any rights, defences and remedies available under that law continue to apply.

Changes to these Terms

Updated documents identify their version and effective date. We will bring material changes to your attention and request a new agreement where appropriate. A new version does not retrospectively change the terms of an earlier transaction.

You can decline updated terms and contact us to arrange cancellation or make a data request. Where a change affects an existing paid period, we will consider the appropriate access arrangements or remedy rather than treating continued use as a waiver of your rights.

Governing law and complaints

These Terms are governed by the laws of Victoria, Australia. This does not remove mandatory rights or access to a court, tribunal or complaints body available to you under applicable law.

For service, billing, privacy or intellectual property concerns, use the Contact & Privacy Complaints page or the contact details above. We will consider your concern and respond in plain language.

Questions or concerns? See our Contact & Privacy Complaints page, or raise a request from Account Settings (Legal & Privacy).
